This isn't the usual behavior of AVG program. From your description, it seems that there are few issues for the patches to get applied to your program.

When opening up My AVG to scan, at the top is says OUT OF DATE. When I hit update it shows all is up to date. I have re started the computer several times even shut it down and let it rest all night. It stills comes up "out of date". How can I solve this issue?
